Terms of Service
These terms are an agreement between you and Bartlett Group LLC, a New Jersey limited liability company, covering your use of PlateShot at plateshot.app. By creating an account or using the demo, you agree to them.
1. Who can use PlateShot
You must be at least 18 years old. If you are using PlateShot for a restaurant or other business, you confirm you are authorised to accept these terms on its behalf.
2. What the service does
PlateShot enhances food photos with AI, lets you place them into social media templates with your own logo and text, and helps you publish or schedule those posts to connected platforms. Features change as the product develops, and we may add, modify or retire them.
3. Your account
Keep your password confidential and let us know promptly if you think someone else has access. You are responsible for activity that happens under your account. One account per person or business — do not share logins.
4. The free demo
The homepage demo lets you enhance a limited number of photos at no cost. Demo results are watermarked and intended for evaluation. We may change or withdraw the demo, and we may limit or block attempts to reset or bypass the trial counter.
5. Pro subscription and billing
- PlateShot Pro costs $49 per month, charged to your payment method through our payment processor.
- The subscription renews automatically each month until you cancel.
- You can cancel at any time from your settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- We do not give refunds for partial periods or unused photo allowance, except where the law requires it.
- Pro includes a monthly allowance of photo enhancements. Allowances reset each billing period and do not roll over. Automated, bulk or resale-scale use beyond ordinary restaurant use is not permitted.
- If we change the price we will give you at least 30 days' notice by email, and the new price applies from your next renewal.
- If a payment fails we may retry it and suspend access until it clears.
- Taxes, where applicable, are added to the listed price.
6. Your photos and content
You keep ownership of the photos, logos and text you upload, and of the enhanced images we generate from them. You are free to use enhanced images (unwatermarked, on a paid plan) commercially for your business.
You grant us a limited, non-exclusive licence to host, process, reproduce and display your content solely to operate and support the service — for example enhancing a photo, rendering a template, storing your library or publishing a post you have scheduled. This licence ends when you delete the content, subject to short technical backup delays.
You confirm you have the rights to everything you upload, including any trademarks, people or venues shown in the photos.
7. Acceptable use
You agree not to:
- Upload content you do not have the rights to use.
- Upload unlawful, infringing, deceptive, hateful, sexual or abusive material.
- Use PlateShot to mislead consumers about a product you do not sell.
- Attempt to circumvent trial limits, plan allowances or access controls.
- Reverse engineer, scrape, resell or rebrand the service, or use it to build a competing product.
- Interfere with the service's operation or security, or with other users' accounts.
8. About AI-generated results
Enhanced images are AI interpretations of your original photo. Lighting, colour, texture and background may differ from the dish as served, and results vary between runs. Review every image before you publish it, and do not use one if it would misrepresent what a customer receives. You are responsible for the images you publish and for any advertising rules that apply to them.
9. Connected platforms
Publishing to Instagram, Facebook or Google depends on those platforms' APIs and is subject to their own terms and policies. We cannot guarantee a post will be delivered, and we are not responsible for a platform changing its rules, rate limits or availability, or for action it takes against your account.
10. Our intellectual property
PlateShot's software, templates, brand, name and logo belong to us. You may use the templates within the service to create posts for your business, but you may not extract, redistribute or resell the template designs themselves.
If you send us feedback or suggestions, you grant us the right to use them freely without obligation to you.
11. Suspension and termination
You may stop using PlateShot and delete your account at any time. We may suspend or terminate access if you breach these terms, if your payment fails, or if we are required to by law — and we may discontinue the service with reasonable notice. When an account is closed, stored photos and designs are deleted, so download anything you want to keep first.
12. Disclaimers
PlateShot is provided "as is" and "as available". We do not warrant that the service will be uninterrupted or error-free, that enhanced images will meet a particular standard, or that using PlateShot will produce any specific marketing or sales result. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, goodwill or data. Our total liability arising out of or relating to these terms is limited to the greater of $100 or the amount you paid us in the 12 months before the claim.
Nothing here limits liability that cannot be limited by law, including your statutory consumer rights.
14. Indemnity
You agree to indemnify and hold Bartlett Group LLC harmless from claims, losses and expenses arising from content you upload or publish, your use of the service, or your breach of these terms.
15. Governing law and disputes
These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law rules. Before starting formal proceedings, please email contact@barlettgroupllc.com so we can try to resolve the issue informally within 30 days. Disputes that remain unresolved will be handled by the state or federal courts located in New Jersey, and you consent to their jurisdiction.
16. Changes and contact
We may update these terms as the product evolves and will revise the "last updated" date above. Material changes will be announced to account holders by email; continuing to use PlateShot after a change means you accept the updated terms.
